ADA Compliant Pool Lifts For The Hospitality Industry.
The Department of Justice published revised final ADA regulations
for state and local government services,
public accomodations and
commercial facilities on Sept. 15, 2010.
But what does this mean for you? Answers to your ADA questions.
Q: Does my pool need a pool lift?
A: Yes, any commercial pool with 300 linear feet or more needs two
means of access. All hotel and commercial pools will need an ADA
compliant handicapped entry.
Q: What is a commercial pool?
A: Any pool that is open to the public at any time, receives government
funding, or receives revenue from the pool such as membership dues.
Q: Does my spa, wave action pool, leisure river, wading pool or
sand bottom pool need a pool lift?
A: They all need an access point. A wading pool must have a sloped
entry. A spa must have a pool lift, transfer wall or transfer system.
Q: How do I know if my pool lift is ADA compliant?
A: 1. Purchase your lift from an Aqua Creek Distributor, like Ganga Hospitality Corp.
2. Lift must have a capacity of 300 lbs or more.
3. Lift must have solid seat and footrest. Sling styles are not compliant and need to be replaced.
4. Lift must be self operable from the deck and the water. A lift with manual rotate or hand crank is not compliant and should be replaced.
5. Sling style seats and chains are not compliant.
Q: Is there a liability for non-compliance?
A: Owners who fail to comply with the new ADA requirements do so at
their own risk, as the civil penalties for non-compliance could be as
high as $55,000 for the initial breach and $110,000 for each
subsequent infraction. www.ada.gov/enforce.htm
There are specific requirements for clear deck space and water depths. Contact Ganga Hospitality at (800) 575-6361 for more information. Always check your local codes for additional requirements.
Law went into effect March 15, 2011 with a date of mandatory compliance of January 31, 2013.
